Fintary Inc., together with its affiliates, agents, and licensees, (collectively “Fintary”, "we", "our", or "us") develops financial operations solutions for our business Customers ("Customers, “you”, or “your”). This Privacy Policy explains what information may be collected when you access this website (“Website”) or use any of our mobile or other applications (“Applications”), how we and others use this information, under what circumstances we may disclose the information to third parties, and the instances in which we may allow third parties to collect information directly. Applications may include the financial operations solutions we have developed, which solutions include tools and functionalities that can be integrated into Customers’ revenue reconciliation, commission payout, forecasting systems. Website and Applications are herein collectively referred to as our "Service". Depending on your activities when using or accessing our Service, you may from time-to-time be required to agree to additional terms and conditions. This Privacy Policy applies regardless of whether you use our Services via a computer, mobile device, or other platform (collectively, your “Equipment”).
Fintary understands that privacy is important to our users. By accessing or using our Service, you agree to be bound by this Privacy Policy and all of the terms incorporated herein by reference. By using our Service and/or submitting or collecting any personal data via our Service, you accept and expressly consent and agree to our practices surrounding the collection, use, and sharing of your personal information in accordance with this Privacy Policy. IF YOU DO NOT CONSENT AND AGREE WITH THE TERMS OF THIS PRIVACY POLICY, YOU CANNOT, AND WE DO NOT AUTHORIZE YOU TO, ACCESS, BROWSE, OR USE OUR SERVICE.

1. What information do we collect and for what purpose?
Information you provide to Fintary’s Website: Visitors can browse some areas of our Website without providing any personal information. However, certain interactions with us require personal information.
Information that we collect through Fintary’s Service: In providing Service to our Customers, we may collect, store, process and disclose personal information belonging to individuals who are employed by or affiliated with our Customers. We handle personal information solely on behalf of our Customers and in accordance with our agreements with our Customers. We collect, use, store or transfer various different kinds of information from you, about you, or about your Equipment when you use our Service, including:
• Contact information such as your name, mailing or delivery address, email address, telephone number, or similar contact information.
• Unique identifiers including online identifier, IP address, mobile device identifiers, username, or similar identifier.
• Financial information such as your billing address, credit card information, and other payment-related information.
• Commercial information including details of our products and services (including apps) that you have purchased, obtained, or considered.
• Internet or other similar network activity including your browsing history, search history, information about your interactions with our websites, applications, or advertisements.
• Technical information such as your internet protocol (IP) address, your login data, browser type and version, time zone setting, location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access the Service.
• Profile information such as your username and password, purchases or orders made by you, your interests, preferences, feedback, product reviews, survey responses, and other similar information.
• Usage information including information about how you use our websites, apps, products, and services.
• Marketing and communications information such as your preferences in receiving marketing from us and your communication preferences.
• Employment information such as your company or employer/workers, if the information is linked to your identifying information.
Some of the information we collect about you may be personal information that can be used to identify you, including – for example, your name, email address, mailing address or delivery address. In some jurisdictions, certain unique identifiers like IP addresses and other usage or technical information may be considered personal information. However, in no instance does personal information herein include data where your identity has been removed so that we can no longer identify you (anonymous data), which we may use for any purpose.
For your information, here are some examples of how Fintary collects and uses information in the course of providing our Service to our Customers:
• We collect information you provide to our Customer through the Service, such as when your commission payments. Such information could include your name, photo, contact information, and other information typically found in financial operations systems;
• We collect information about you provided by our Customer, which may include your name, job title, contact information, email address, and other information;
• We may permit you to provide additional contact and profile information, or to connect your account with your company address book or calendar, or to a third party service such as Facebook, Google or LinkedIn, in which case we may also collect information available through that third party service. Please always check your permissions on third party sites before connecting them to our Service;
• We provide analytics and reporting functionalities to Customers to help manage and analyze workforce capabilities and efficiencies;
• We may allow you to post messages or other content for other members of the Service and to communicate directly with others through the Service.
The type of personal information we collect from or about you, and the ways in which such data are shared with other members of the Service will depend on the functionalities and guidelines established by our Customer pursuant to our Agreement with our Customer and the Customer's settings on the Service.
We use this information to operate, maintain, and provide to you the features of the Service. We may use this information to communicate with you, such as to send you email messages, or text messages with your consent, or to permit other users of the Service to send you such messages, and to follow up with you to offer information about our Service and your account. We may also send you Service related emails or messages (e.g., account verification, transactional communications, change or updates to features of the Service, technical and security notices). We reserve the right, but have no obligation, to monitor any user generated content you post on the Service. We reserve the right to remove any such information or material for any reason or no reason, including without limitation if in our sole opinion such information or material violates, or may violate, any applicable law or our Terms of Service Agreement, or to protect or defend our rights or property or those of any third party. We also reserve the right to remove information upon the request of any third party.
2. How we use cookies and other tracking technology to collect information
We collect information from you in different ways and from different places, including:
• You provide it to us directly. You may give us information about you by filling in forms or by communicating with us by text, e-mail, or otherwise. This includes information you provide when you create an account, purchase, and use our products and services, complete a survey, provide feedback, report a problem, or otherwise contact us about our Service, or provide information to be published or displayed on public areas of our Service or transmitted to others.
• We automatically collect using technology from our websites, applications, and emails. As you interact with our Service, we may automatically collect technical data about your Equipment, browsing actions and patterns as specified above. We collect this information by using cookies, server logs, web beacons, and other similar technologies.
• From other places. We may receive information about you from other companies and individuals including, for example, business partners, subcontractors, advertising networks, social network platforms, analytics providers, and service providers. We may also receive information about you from other users if, for example, another user purchases one of our services on your behalf or provides us your email address to receive a discount.
We may use automatic data collection technologies when you visit our Website, App, view our advertisements, or use our Service. For example, we may use cookies to distinguish you from other users of the Service to help us deliver a better and more personalized service when you use our Service. It also allows us to improve our Service by enabling us to:
• Estimate our audience size and usage patterns.
• Store your preferences so that we may customize our Service according to your individual interests.
• Speed up your searches.

• Web Beacons. Our Service pages and e-mails may contain small transparent embedded images or objects known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count website page visitors or email readers, or to compile other similar statistics such as recording Service content popularity or verifying system and server integrity.
• Mobile Device Identifiers: Mobile device identifiers help us learn more about our users’ demographics and Internet behaviors in order to personalize and improve our Service. Mobile device identifiers are data stored on mobile devices that may track activities occurring on and through it, as well as the applications installed on it. Mobile device identifiers enable collection of personal information (such as media access control, address, and location) and Traffic Data.
Some web browsers (including Safari, Internet Explorer, Firefox, and Chrome) incorporate a “Do Not Track” (DNT) or similar feature that signals to web services that a visitor does not want to have their online activity and behavior tracked. New standards are being developed for a Universal Opt-Out Mechanism, such as the Global Privacy Control (GPC), which allow users with GPC-enabled browsers and devices to send a signal that will communicate the user’s request to opt-out of sales of their personal information and to opt-out of certain sharing of their personal information. The CPRA and other laws allow for the acceptance of Opt-Out Preference Signals such as the GPC, as an option for users to transmit an Opt-Out of selling/sharing personal information. If we detect and recognize such a signal from your device or browser, we will honor it.

We use your information to provide you with products, offer you services, communicate with you, deliver advertising and marketing, or to conduct other business operations, such as using information to improve and personalize your experiences. • To our contractors, service providers, and other third parties we use to support our business and who are obligated to keep personal information confidential and use it only for the purpose for which we disclose it to them.

• To fulfill the purpose for which you provide it.
• To an actual or prospective buyer or other successor in the event of merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of our assets, where one of the transferred assets is the personal information we hold.
We may also disclose personal information to others:
• To comply with any court order, law, or legal process, including responding to any government or regulatory request.
• To enforce or apply our terms of use or other agreements including for bill and collections purposes.
• To protect the rights, property, or safety of our business, our employees, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of cybersecurity, fraud protection and credit risk reduction.
• To investigate suspected violations of any law, rule or regulation, or the terms or policies for our Service.
As described above, any personal information that we receive or have access to in the course of providing our Service to a Customer, is shared by Fintary solely on behalf of the Customer, and in accordance with our agreements with the Customer, unless you agree to participate in additional services offered by Fintary. Therefore, if you are interacting in the hiring, onboarding and workflow performance context with one of our Customers, please review the Customer's Privacy Policy, Terms of Service, employment policies and procedures or other notices, and the Customer's settings on the Service to learn more about the Customer's information practices, including the use of service providers like Fintary.
4. Your choices about your information
How to control your communications preferences: You can stop receiving promotional email communications from us by clicking on the "unsubscribe link" provided in such communications. We make every effort to promptly process all unsubscribe requests. You may not opt out of Servicerelated communications (e.g., account verification, transactional communications, changes/updates to features of the Service, technical and security notices).
Modifying or deleting your information. We will retain your information for as long as your account is active or as needed to provide you Service. You may view and modify your personal information through your account settings. We may not be able to modify or delete your information in all circumstances. For example, information we collect in the course of providing the Service is shared with our Customer and we do not control access to nor delete that information once it has been shared with our Customer. In some cases, we may not be able to remove your personally identifiable information, in which case we will let you know if we are unable to do so and why. You can also contact the Customer directly to learn more about how the Customer uses and stores your personal information.
5. How we store and protect your information
Storage and processing: Your information collected through the Service may be stored and processed in the United States and in any other country in which Fintary or its subsidiaries, affiliates or service providers maintain facilities. If you are located in the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that we may transfer information, including personal information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction, and you consent to the transfer of information to the U.S. or any other country in which Fintary or its parent, subsidiaries, affiliates or service providers maintain facilities and the use and disclosure of information about you as described in this Privacy Policy. If you are a Customer with employees, team members or other end users located in the European Union, you confirm that you have the right to consent to the transfer of end user data to our Service and to facilities located in the United States or in any other country in which Fintary or its service providers maintain facilities.
Keeping your information safe: Fintary cares about the security of your information, and uses commercially reasonable physical, administrative, and technological safeguards to preserve the integrity and security of all information collected through the Service. However, no security system is impenetrable and we cannot guarantee the security of our systems 100%. In the event that any information under our control is compromised as a result of a breach of security, Fintary will investigate the situation and where appropriate, notify those individuals whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations. Where we have given you (or where you have chosen) a password for access to certain parts of our Service, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.
6. Children's privacy
We do not direct our Website, Applications, or services to minors, and we do not knowingly collect or solicit any information from anyone under the age of 16 or knowingly allow such persons to register as Users. If you are under 16, do not use or provide any information through the Service. In the event that we learn that we have collected personal information from a child under age 16, we will delete that information as quickly as possible. 7. Links to other web sites and services
Our Service may integrate with or contain links to other third party sites and services. We are not responsible for the practices employed by third party websites or services embedded in, linked to, linked from, or connected with the Service and your interactions with any third party website or service are subject to that third party's own rules and policies.
A. Interest-Based Advertising
Our Service may integrate technology of third-party advertising networks (“Ad Networks”) that allows for the recognition of your Equipment and the collection of information about the browsing, searching and other activities of you or anyone else using your Equipment. This information is then used to send you advertisements for products and services that are more likely to be of interest to you. For more information on how this type of advertising works, go to www.aboutads.info.
To enable interest-based advertising across your Equipment and software, we may also share data, such as technical identifiers derived from your registration information on our Service or our CRM system, with these Ad Networks. This allows them to link your Equipment, browser, etc. and to better identify you across different environments.
If you do not wish to participate in interest-based advertising via Ad Networks, you may opt-out by visiting and following the instructions set forth at either: (1) the Digital Advertising Alliance’s website (www.aboutads.info); or (2) the Network Advertising Initiative’s website (www.networkadvertising.org/choices). A couple of important notes about these opt-out tool: (i) it includes all the advertising networks that we may work with, but also many that we do not work with; and (ii) it may rely on cookies to ensure that a given advertising network does not collect information about you (“Opt-out Cookies”) – an explanation of how Opt-out Cookies work can be found on www.aboutads.info. Therefore, if you use different Equipment, change web browser, or delete these Opt-out Cookies, you will need to perform the opt-out task again.
Finally, please note that certain browsers may offer you the option of providing notice to websites that you do not wish for your online activities to be tracked for interest-based advertising purposes (“DNT Notice”). Some browsers are, by default, set to provide a DNT Notice, whether or not that reflects your preference. Unfortunately, given how preference-based advertising works, DNT Notices may not be effective in communicating your preferences. For this and a variety of other reasons, with respect to our Service, we do not take any action based on browser based DNT Notices. B. Social Networks, Third-Party Links, Forums
Our Service may integrate social network plugins, include links to third-party websites or services, or provide you the opportunity to post content. Please keep the following in mind:

• Location Information. When you use our Service, particularly our Application(s), we may automatically collect certain Equipment (mobile device) specific information. This includes the general or specific location of your Equipment through GPS, Bluetooth, or WiFi signals. Before we collect or send location-specific information, it is our practice to ask for your consent. In some instances, your operating system may not allow you to install an Application without giving us consent. In all instances, you may withdraw your consent by disabling location features for your Equipment.
• Cookies and automatic data collection technologies. You can set your browser to refuse all or some browser cookies, or to alert you when websites set or access cookies. Flash cookies are not managed by the same browser settings used for browser cookies. To learn how you can manage your Flash cookie settings, visit the Flash player settings page on Adobe’s website. However, if you disable or refuse cookies, please note that some parts of the Service may become inaccessible or not function properly.
• Interest Based Advertising. Please see Interest-Based Advertising above for information on how to opt-out of interest-based advertising.
